1. Payment & Booking

• All products must be paid for in full on the day of the photoshoot.
• Payment confirms acceptance of this agreement, including these Terms & Conditions.
• The completed album will be presented for inspection before final payment. Once you confirm it meets the agreed specification, the balance becomes payable immediately.
• Optional add-ons may be purchased on the day.
• Any booking deposit is subject to the separate deposit terms shown during booking.

2. Delivery of Products

• The physical printed album will be presented for inspection before final payment. After you confirm it meets the agreed specification and pay the balance, the album will be provided before you leave the premises.
• Your E-folio website will be delivered within 24 hours of full payment.
• Digital photographs will be delivered according to your agreed specification within 24 hours of full payment.
• Delivery times may vary slightly during peak periods. We will clearly communicate any delay.
• You are responsible for checking and approving names, spellings, photographs, layouts and personalisation before production. Amendments requested after approval may incur additional charges, which we will discuss with you before carrying out the additional work.

3. Image Rights & Usage

• Sandhurst Digital Studios Ltd retains copyright in its original creative work unless copyright is expressly assigned in writing.
• After full payment, you receive the final edited digital images and a perpetual, worldwide, royalty-free licence to copy, print, edit, crop, enhance, resize, publish, upload, share, reproduce, use commercially or personally, and incorporate those images into future works.
• We will use selected images for marketing only if you give us prior written permission. You may withhold permission without affecting your booking.

4. Agency Submission

• Agency submission does not guarantee acceptance, representation or future work.
• The agency may contact you directly if it is interested.

5. Rescheduling & Cancellations

• You may reschedule a booking once by giving at least 24 hours' notice.
• For a same-day cancellation or a missed appointment, we will offer you a new booking. Any booking deposit remains subject to the separate deposit terms shown during booking.
• Personalised products are not refundable for a change of mind, subject to your statutory rights.
• You must inspect the completed album before making final payment. Payment and collection confirm acceptance of visible features against the agreed specification, but do not affect your rights concerning hidden manufacturing defects or any other statutory rights.
• Refunds are not available for changes of mind or errors in details you approved, except where required by law.
• Your statutory rights relating to faulty goods remain unaffected. The cancellation and refund terms on this page, our Privacy Policy and details of how to make a complaint are available on our website.

6. Client Responsibilities

• Arrive on time for your scheduled appointment.
• Follow studio safety instructions.
• Treat staff respectfully.
• Provide accurate contact information.

7. Retouching & Creative Direction

• Standard retouching includes colour correction, skin smoothing and general enhancement.
• Advanced retouching may incur additional charges. We will agree any additional charge with you before undertaking the work.
• The photographer provides creative direction unless otherwise agreed.
• Minor colour differences between digital displays and printed products are normal.
• Manufacturing defects reported within 30 days will be inspected and, where appropriate, repaired or replaced. This does not limit any longer statutory rights. This provision does not cover accidental damage, misuse or normal wear.

8. Liability

• To the extent permitted by law, we are not responsible for loss of or damage to personal belongings brought to the studio.
• We are not liable for indirect or consequential loss arising from a photoshoot or agency submission, except where such liability cannot lawfully be excluded.
• Studio photographers will carry out their duties with reasonable skill and care.
• We are not liable for events beyond our reasonable control, including equipment failure, power outages or illness, that prevent us from providing services as planned. In those circumstances, we will make reasonable efforts to provide an equivalent service or make alternative arrangements.
• To the extent permitted by law, our total liability is limited to the amount you paid for the relevant order. Nothing in this agreement excludes or limits liability or consumer rights that cannot legally be excluded or limited.

9. Data Protection & Consent for Use of Images

• We process customer information and photographs to provide the services and products ordered and to administer your order, in accordance with UK data-protection law and our Privacy Policy.
• Images will not be used for marketing without your permission. Any permission for marketing use is separate from your purchase and may be withheld.
• You may request deletion of your personal information. We may need to retain some information where required by law or for the establishment, exercise or defence of legal claims.
• Sandhurst Digital Studios Ltd is registered with the Information Commissioner's Office (ICO). ICO Registration Number: ZC233256.

10. Entire Agreement

This agreement, together with the applicable booking or order specification and any written amendments, represents the full understanding between you and the Company in relation to the services and products ordered. It does not exclude liability for fraud or any rights that cannot be excluded by law.

11. Amendments

No part of this agreement may be altered or amended unless the change is recorded in writing and agreed by both parties. This does not affect any rights that cannot legally be varied or excluded.

12. No Guarantee of Employment

Photo Shoot Models does not provide employment, representation or work in any industry. Any agency submission is subject to section 4 and does not guarantee acceptance, representation or work.

13. Non-Waiver & Payment Plans

Accepting a late or partial payment does not waive any of the Company's rights or claims under this agreement. Any agreed partial-payment plan will be interest-free and must be settled within 10 months, unless we agree otherwise in writing.

14. Third-Party Rights & Assignment

Nothing in this agreement is intended to give rights or benefits to a third party. The Contracts (Rights of Third Parties) Act 1999 does not apply to this agreement.

The Company may assign or transfer its rights under this agreement. This does not affect your statutory rights.

15. Indemnity

You are responsible for claims, costs and expenses arising from your breach of this agreement, negligence or unlawful use of our services. Nothing in this section requires you to indemnify the Company for the Company's own breach, negligence or liability that cannot lawfully be excluded.

16. Disclaimer of Warranty

Services, materials and products are supplied in accordance with the applicable order specification. Nothing in this agreement excludes or limits statutory terms, guarantees or remedies, including those concerning satisfactory quality, fitness for purpose or services performed with reasonable care and skill.

17. Execution of Agreement

By making payment, you confirm that you have authority to enter into this agreement and accept these Terms & Conditions, the applicable Refund & Cancellation Policy, album specification and Digital Portfolio licence provided for your order. The Company confirms that it has authority to enter into this agreement.

18. Governing Law

This agreement is governed by the laws of England and Wales. If you are a consumer living elsewhere in the United Kingdom, you will also retain any mandatory protections available to you under the law of your place of residence.
